An Arizona man is being sued by 16 Illegal Aliens who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.
His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as “the avenue of choice” for immigrants seeking to enter the United States illegally.
Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett’s wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.
The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.
Attorneys for the immigrants – five women and 11 men who were trying to cross illegally into the United States – have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.
The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at “gunpoint, yelling obscenities at them and kicking one of the women.”
In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English and Spanish. At one point, it said, Mr. Barnett’s dog barked at several of the women and he yelled at them in Spanish, “My dog is hungry and he’s hungry for buttocks.”
The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

two thoughts:
1. Civil Rights are protected by the Constitution of the United States, which does not apply to ILLEGAL immigrants. Any Lawyer involved in the Prosecution, as well as any judge that hears this case and doesn’t instantly throw it out ought to be tarred and feathered then tossed into canada.
2. I guess next time he’ll just have to shoot them rather than having them arrested and brought back to their country of LEGAL residence.

Hubby and I were going through tough times — unemployment for him — and there were days when you were very encouraging — I went on the dead thread to thank you and you had left the “other blog”

Things are still rough — he got a job, then shortly after discovered the cancer he had fought off 17 years ago has returned in a different form — 20% chance to survive the first time — this time over a 70% chance to keep it under control but it’s not easy – so far, though he is working and fighting

The 5 is because of our 7 week old granddaughter. She is quiet a little blessing, and her and the oldest daughter live with us right now.
I hated leaving the dead thread folks at the dreaded LGF, but nobody was around anymore, and the talking with the other folks wasn’t any fun. I haven’t posted much since 9/11/08 on that other blog for other reasons.
Happy to hear your hubby has another job! I know that was weighing on you, and being I can certainly understand the helplessness he musta felt not being able to take care of his beautiful lady the way he wants to. I pray your constant love will help see him through this difficult time, although if he’s anything like me, he’ll probably be more worried about you than himself.
It’s about 60 degrees up here, really nice day. The ice is melting and my Golden Retriever will be able to jump back in the water.
Paul told us that we’d never be given more than we could handle. My hope is his faithfulness will somewhat subdue your doubts.

Unfortunately that is illegal. In fact, it is illegal to booby trap your property at all, even though someone has to be committing an ilelgal act to trigger the booby trap (i.e, breaking and entering).
EVEN if it is a situation where you could legally shoot them dead, it is illegal to have a booby trap that kills them.
but that’s ok. We have President Obama, and he’s going to give everyone a home and a car and make our grandchildren pay for it. (never thought I’d be glad to be childless.)
